The Kate Steinle Verdict is a Miscarriage of Justice

One would think that picking up a gun and shooting someone would be against the law.

Well, in California, it turns out there’s a loophole. All you have to do is be hated by Republicans, and the liberals will let you off the hook to benefit their narrative. That’s exactly what happened in the case of Jose Garcia Zarate, who killed Kate Steinle, a young woman out walking with her dad.

Zarate is an illegal immigrant who has been deported not once, not twice, not even thrice, but four times. He made his way back in to the country, even after being found guilty of several drug crimes, where he managed to obtain a gun and end an innocent life.

His defense argued, plainly, that Zarate is an idiot who doesn’t know any better. His story is that he happened to be at the Los Angeles pier where this whole incident occurred, sat on a bench, noticed a bundled piece of clothing and investigated it. Within, he found a gun and became curious. Upon inspection of the gun, it went off. The bullet ricocheted off the ground and found Kate Steinle’s back where it pierced through and severed her aorta.

Kate bled to death in her father’s arms. Her last words were, “Help me, dad.”

But that’s it. Just a freak accident that occurred when an illegal immigrant happened to investigate a random bundle of clothing wherein he found a powerful handgun in the most gun-restricted city in the country. Then, the gun magically discharged because he picked it up wrong. The noise startled him so much that he then threw the gun into the bay and ran.

Now, the defense was attempting to argue that there was no intent. The prosecution was trying to prove that Zarate was guilty of murder, which is a charge that requires intent. But, at the very least, the jury should have found Zarate guilty of involuntary manslaughter. Definitionally, IM only requires there to be a death which occurred due to someone’s careless or reckless actions. Even Zarate’s defense argued that this was the case.

Regardless of what happened at the trial, the political debate swirling around this incident is centered around the correct notion that Zarate shouldn’t have been here in the first place. GOP leaders, including the President himself, argue that sanctuary cities and feckless border security resulted in Kate Steinle’s death. In fact, President Trump campaigned heavily on this issue and used it as reasoning for the construction of a border wall and an end to sanctuary policies.

Democrats don’t really have an answer for it. Their main talking point on this issue is that local law enforcement officials should maintain good working relationships with illegal immigrant populations to go after criminal aliens. The logic is that cracking down on all illegal immigrants will make the population un cooperative and hinder police officers in catching the really bad guys.

The flip side to that argument is that federal officers should be ignored by local officers, creating a damaged relationship between the various levels of America’s law enforcement. If law enforcement is united, the job gets done.

Zarate was arraigned for possession of an illegal firearm, and could face some jail time. U.S. Immigration and Customs Enforcement (ICE) has said that Zarate will be deported as soon as he is turned in to federal officers upon completion of his sentence.

Hopefully, there will be a wall in place at the border to keep him from coming in a fifth time.
